In Florida, three companies have run such games, including <a href=\"https:\/\/www.casino.org\/news\/leading-us-sportsbook-brands-scale-back-advertising-spend\/\" rel=\"nofollow noopener\" target=\"_blank\">PrizePicks<\/a>, Betr, and Underdog Fantasy.<\/p>\n<p class=\"p1\">On January 31, state gaming regulators told the trio that they must terminate such games in the Sunshine State within 30 days. That means pick\u2019em games must cease by March 1 (2024 is a Leap Year, meaning February has 29 days).<\/p>\n<blockquote class=\"main-blockquote\">\n<p class=\"p1\"><strong>If this cessation is completed within that timeframe, the Commission will deem the company and all its officials, directors, and employees to have complied with the demands of the cease-and-desist order, and the Commission will not take further action, including referral to the Office of Statewide Prosecution or to any State Attorney,\u201d<\/strong> the letters read.<\/p>\n<\/blockquote>\n<p class=\"p1\">The state gaming regulatory said nothing in the cease-and-desist letters prohibits the companies from operating contests that are \u201cin compliance with the law.\u201d All three are expected to comply with the order.<\/p>\n<h2 class=\"p1\"><span class=\"ez-toc-section\" id=\"Florida_Gaming_Environment\"><\/span><b>Florida Gaming Environment<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"p1\">The Seminole Tribe holds a monopoly on most house-banked table games in the state, and on Las Vegas-style slot machines outside of Miami-Dade and Broward counties. The tribe amended its <a href=\"https:\/\/www.casino.org\/news\/seminole-tribe-reaches-historic-gaming-expansion-deal-with-state\/\" rel=\"nofollow noopener\" target=\"_blank\">Class III gaming compact<\/a> with Gov. Ron DeSantis (R) in 2021. That expanded its gaming privileges to include not only craps and roulette, but also retail and online sports betting.<\/p>\n<div class=\"callout\">\n<p class=\"p1\">The online sports betting component caused a legal challenge on allegations that the compact breaches the Indian Gaming Regulatory Act (IGRA). The federal law requires that tribal gaming only operate on sovereign lands.<\/p>\n<\/div>\n<p class=\"p1\">The Seminoles and <a href=\"https:\/\/www.casino.org\/news\/desantis-exit-from-gop-primary-further-shortens-trumps-odds\/\" rel=\"nofollow noopener\" target=\"_blank\">DeSantis<\/a> disagreed on claims that the \u201chub-and-spoke\u201d approach \u2014 where bets are placed remotely via the internet, but only facilitated through sportsbook computer servers on Seminole land \u2014 satisfies the federal Indian gaming statute. The case is being <a href=\"https:\/\/www.casino.org\/news\/scotus-asked-to-torpedo-seminole-sports-betting-deal-in-florida\/\" rel=\"nofollow noopener\" target=\"_blank\">appealed to the U.S. Supreme Court<\/a>.<\/p>\n<p class=\"p1\">Hard Rock Bet, the Tribe\u2019s sportsbook brand, <a href=\"https:\/\/www.casino.org\/news\/online-sports-betting-now-open-to-all-in-florida\/\" rel=\"nofollow noopener\" target=\"_blank\">returned online in December<\/a>. Officials at Hard Rock International, which is owned by the Seminoles, say the pick\u2019em fantasy sports games violate their compact because players are betting money against the house.<\/p>\n<p class=\"p1\"><strong>Jim Allen, Hard Rock chairman and CEO, said in January that the tribe doesn\u2019t have an issue with traditional DFS games like the ones DraftKings and FanDuel operate in Florida.<\/strong><\/p>\n<p class=\"p1\">\u201cWhat [PrizePicks, Betr, Underdog] are doing is gambling,\u201d Allen told <i>WFTV9<\/i>. \u201cThey\u2019re taking live bets. It\u2019s illegal and unequivocally violates the [Seminole] compact.\u201d<\/p>\n<h2 class=\"p1\"><span class=\"ez-toc-section\" id=\"Seminole_Influence\"><\/span><b>Seminole Influence<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"p1\">The Seminoles\u2019 position on the pick\u2019em games and the gaming commission taking swift action is yet another telling sign of the Tribe\u2019s power in Florida.<\/p>\n<div class=\"callout\">\n<p class=\"p1\">State gaming regulators, however, said their counsel advised that fantasy sports operators can only do business in the state if they merely put up a purse and charge an entry fee to participate. The Gaming Control Commission says Betr, PrizePicks, and Underdog do the opposite in participating in the contest and winning the prize if the contestant doesn\u2019t correctly guess the outcome.<\/p>\n<\/div>\n<p class=\"p1\">That\u2019s why, the state says, DraftKings and FanDuel did not receive such cease-and-desist orders.<\/p>\n<p class=\"p1\"><strong>Florida\u2019s fantasy sports regulations are cloudy at best.
