(Image: Circa Sports)<\/figcaption><\/figure>\n<p class=\"p1\"><span class=\"s1\">During the Massachusetts Gaming Commission\u2019s (MGC) Thursday meeting, the topic of <a href=\"https:\/\/www.casino.org\/news\/massachusetts-online-sports-betting-begins-six-platforms\/\" rel=\"nofollow noopener\" target=\"_blank\">operators limiting bettors<\/a> was discussed toward the end of the more than two-hour gathering. The agency heard from Andrew Steffen, the MGC\u2019s sports wagering operations manager, who explained that the conversation was initiated last year by a member of the public who questioned whether the business practice was permitted under Massachusetts\u2019 <a href=\"https:\/\/www.casino.org\/news\/draftkings-flutter-pinched-by-new-regulatory-headwinds\/\" rel=\"nofollow noopener\" target=\"_blank\">sports gambling regulations<\/a>. <\/span><\/p>\n<div class=\"callout\">\n<p class=\"p1\"><span class=\"s1\">Steffen told the commissioners that the Sports Wagering Division recently concluded that the practice is permissible under the state\u2019s sports wagering <a href=\"https:\/\/www.casino.org\/news\/massachusetts-regulators-say-betmgm-violated-player-prop\/\" rel=\"nofollow noopener\" target=\"_blank\">rules<\/a>. Steffen cited the MGC\u2019s \u201cMinimum and Maximum Wagers: Additional Wagering Requirements\u201d statute.<\/span><\/p>\n<\/div>\n<p class=\"p1\"><span class=\"s1\">\u201cUnless otherwise directed by the Commission, there is no limitation as to the minimum or maximum wager a Sports Wagering Operator may accept,\u201d the statute reads. \u201cThis rule does not preclude a Sports Wagering Operator from establishing its own minimum or maximum wagers, or limiting a patron\u2019s Sports Wager for reasons considered necessary or appropriate by the Sports Wagering Operator.\u201d <\/span><\/p>\n<h2 class=\"p1\"><span class=\"ez-toc-section\" id=\"Sportsbooks_Claim_Righteous_Reasons\"><\/span><span class=\"s1\"><b>Sportsbooks Claim Righteous Reasons<\/b><\/span><span class=\"s1\">\u00a0<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">Steffen told the MGC commissioners and Interim Executive Director Jordan Maynard, who earlier this month was appointed by Gov. Maura Healey (D) to the position following Cathy Judd-Stein\u2019s retirement, that his division met with the MGC\u2019s legal team as well as sportsbooks to determine whether a regulatory change might be warranted.<\/span><\/p>\n<div class=\"callout\">\n<p class=\"p1\"><span class=\"s1\">Steffen said sportsbooks claimed that they set limits on wagers for \u201crisk management\u201d and to \u201cpreserve the integrity of the sporting event.\u201d The licensees also said limits encourage \u201cfair competition\u201d and prevent \u201cundue influence of bets on the outcome of the game.\u201d<\/span><\/p>\n<\/div>\n<p class=\"p1\"><span class=\"s1\">The sportsbooks, Steffen continued, did concede that they also limit bets on a per-customer basis. Much to the irritation of sharps and professional bettors, Massachusetts sportsbooks said proficient bettors are sometimes limited. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The sportsbook reps told Steffen that their sports wagering terms and conditions explicitly state that they have the regulatory right to limit bettors. Boston-based DraftKings provided its house rules agreement that states the book \u201creserves the right to limit the maximum bet amount \u2026 at its sole discretion.\u201d <\/span><\/p>\n<h2 class=\"p1\"><span class=\"ez-toc-section\" id=\"Conversation_Ongoing\"><\/span><span class=\"s1\"><b>Conversation Ongoing<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">Commissioners raised questions about whether <a href=\"https:\/\/www.casino.org\/news\/sports-betting-marketing-under-scrutiny\/\" rel=\"nofollow noopener\" target=\"_blank\">sportsbooks<\/a> limit bettors who regularly lose as often as they do with those who regularly win. With March being Problem Gambling Awareness Month and with <a href=\"https:\/\/www.casino.org\/news\/responsible-gaming-tools-underutilized-massachusetts\/\" rel=\"nofollow noopener\" target=\"_blank\">responsible play in focus<\/a>, Commissioner Eileen O\u2019Brien said the operators might have too much discretion.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">\u201cThere\u2019s a deeper issue here in terms of individual patrons. Their house rules talk very vaguely about management in their sole discretion. What I\u2019m curious to know as a commissioner is, \u2018What\u2019s the basis [for limiting]?&#8217;\u201d O\u2019Brien asked. <\/span><\/p>\n<blockquote class=\"main-blockquote\">\n<p class=\"p1\"><span class=\"s1\">How and why are they making these limitations is critical to whether we need to amend this regulation and help us as we go forward with the research with AI and whether or not we\u2019ll be moving into a regulation that would require some of the information that may very well be going into these limitation determinations to proactively flag problem gamblers,\u201d O\u2019Brien continued. <\/span><\/p>\n<\/blockquote>\n<p class=\"p1\"><span class=\"s1\">The commissioners plan to continue the conversation at a future meeting.
